1. Introduction

Welcome to the SINFT project platform (sinft.net). By accessing or using this website and e-learning platform, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before using the platform. These Terms govern access to all features of the platform, including course content, educational materials, forum participation, assessment submission, and certificate issuance.

These Terms constitute a legally binding agreement between you and the SINFT Consortium Joint Controllers (Poraka Nova Organisation and Angor AG). If you do not agree to these Terms, please refrain from using the platform.

 

2. Definitions

'We', 'us', 'our'refers to the SINFT Consortium Joint Controllers: Poraka Nova Organisation and Angor AG.

 

'You', 'your' refers to the registered user of the platform, whether a learner (student), educator (teacher/instructor), or organisational administrator.

 

'Platform' refers to the SINFT e-learning website and all its features, accessible at sinft.net.

 

'Course' refers to any structured educational programme, module, or learning pathway hosted on the platform.

 

'User-Generated Content'means any content you submit, post, or upload to the platform, including forum posts, discussion contributions, assignment submissions, and profile information.

 

'Certificate'means a digital record of course completion issued by the platform upon fulfilment of defined completion requirements.

 

3. Acceptance of Terms and Changes

By accessing and using this platform, you agree to these Terms and Conditions. If you do not agree, please refrain from using the platform.

We reserve the right to modify these Terms at any time. For material changes — those that affect your rights or obligations — you will be notified at least 14 days in advance via the Moodle policy consent system and by email to your registered address. You will be required to actively accept the updated Terms before continuing to use the platform. Minor changes (corrections, clarifications) may be posted without prior notice. Your continued use of the platform after the effective date of any change constitutes acceptance of the updated Terms.

 

4. Account Registration and User Roles

4.1 Who May Register

Registration on the SINFT platform is not open to the general public. Access is granted only to:

  Individuals formally enrolled as learners in a SINFT Erasmus+ project course, upon invitation by an approved organisation

  Educators, instructors, and course administrators affiliated with consortium partner organisations

  Organisational administrators representing approved consortium member institutions

 

By registering, you represent and warrant that:

  You are at least 18 years of age

  The information you provide at registration is accurate, current, and complete

  You are authorised to access the platform under the terms of your affiliation with a consortium partner organisation or your enrolment in an approved course

  You will maintain the accuracy of your registration information and promptly update it if it changes

4.2 User Roles

The platform operates with distinct user roles, each carrying different access rights and responsibilities:

Ensure content quality and accuracy, treat learners fairly, maintain assessment standards

Organisational Administrator

Manage user enrolments within their organisation, assign roles, access organisational reporting

Ensure only eligible users are enrolled, maintain accurate organisational records

Platform Administrator

Full platform administration access

Technical platform management, security, compliance

 

Role assignment is managed by platform administrators and organisational administrators. You may not attempt to access features or content outside your assigned role.

4.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You must notify us immediately of any unauthorised use of your account at contact@porakanova.org. We are not liable for any loss or damage arising from your failure to maintain account security.

 

5. Use of the Platform

5.1 Permitted Use

The platform is provided for educational purposes in connection with the SINFT Erasmus+ project. You may use the platform only for lawful purposes directly related to your role as described in Section 4.

5.2 Prohibited Conduct

You shall not:

  Engage in any activity that interferes with or disrupts the platform or the servers and networks connected to it

  Attempt to gain unauthorised access to any portion of the platform, other users' accounts, or any systems connected to the platform

  Share your login credentials with any other person

  Use the platform to transmit any unsolicited or unauthorised advertising, promotional material, spam, or any other form of solicitation

  Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable

  Attempt to scrape, harvest, or collect data from other users without their explicit consent

  Use automated tools, bots, or scripts to access, navigate, or interact with the platform

 

6. User-Generated Content

6.1 What Constitutes User-Generated Content

User-Generated Content includes any content you submit or post through the platform, including: forum posts and discussion contributions, assignment submissions and project files, profile information, messages sent through the platform's messaging system, and comments or feedback on course materials.

6.2 Ownership of Your Content

You retain full ownership of any intellectual property rights you hold in the User-Generated Content you submit. Submitting content to the platform does not transfer ownership to us.

6.3 Licence You Grant to Us

By submitting User-Generated Content, you grant the SINFT Consortium a non-exclusive, royalty-free, worldwide licence to use, store, display, reproduce, and distribute that content solely for the purposes of:

  Operating and delivering the educational platform and its services

  Facilitating assessment and feedback processes between learners and educators

  Complying with Erasmus+ project reporting and audit obligations

  Archiving in accordance with data retention requirements

 

This licence does not permit us to sell, commercially exploit, or publish your content beyond these purposes without your explicit consent. Assignment submissions are visible to your course instructors and platform administrators only — not to other learners, unless the course is specifically designed as a peer-review activity, in which case this will be clearly indicated in the course materials.

6.4 Forum Posts and Discussion Content

Forum posts and discussion contributions are visible to all enrolled participants in the relevant course or forum. By posting in a forum, you acknowledge that your contributions may be read by other registered users. Do not post personal information about yourself or others in public forums.

6.5 Content Standards

You are solely responsible for the content you submit. You warrant that your User-Generated Content does not infringe any third party's intellectual property rights, does not violate any applicable law, and complies with the acceptable use requirements in Section 5.2. We reserve the right to remove any User-Generated Content that violates these Terms without prior notice.

 

7. Academic Integrity and Acceptable Use in Learning

7.1 Commitment to Honest Learning

The SINFT platform is an educational environment. All participants are expected to engage with course materials and assessments honestly and in good faith. The integrity of the learning process is fundamental to the value of any completion record or certificate issued through the platform.

7.2 Prohibited Academic Conduct

The following conduct is prohibited and may result in account suspension, removal from a course, or revocation of any certificate issued:

  Submitting work that is not your own as if it were your own (plagiarism)

  Copying or reproducing another participant's assignment submission without attribution

  Using unauthorised assistance during assessments that are designated as individual work

  Sharing assessment questions, answers, or solutions with other participants in a way that provides unfair advantage

  Misrepresenting your identity or credentials

  Manipulating or attempting to manipulate your course completion data or grades

  Accessing or attempting to access assessment materials before they are formally released

7.3 Use of AI Tools

The use of AI-assisted writing or content generation tools (such as large language models) in assignments is subject to the specific policy of each course. Educators will clearly indicate in course materials whether AI tool use is permitted, restricted, or prohibited for specific activities. Where AI use is permitted, you must disclose it as part of your submission. Undisclosed use of AI tools in assessments where such use is prohibited constitutes academic misconduct under this section.

7.4 Reporting

If you believe another participant is engaging in academic misconduct, you may report this to your course instructor or to contact@porakanova.org. Reports will be handled with discretion and in accordance with applicable privacy obligations.

 

8. Completion Data and Certificates

8.1 How Completion Is Determined

Course completion is determined by the completion criteria defined by the course instructor within the platform. These criteria may include: completing specified activities or resources, achieving a minimum grade on assessments, submitting required assignments, and meeting any minimum participation requirements defined in the course. The specific completion requirements are displayed within each course and must be met in full before a certificate is issued.

8.2 Certificate Issuance

Upon meeting all completion requirements, a digital completion certificate may be issued through the platform. Certificates record: your name (as entered in your profile at the time of completion), the course title, the completion date, and the issuing organisation (SINFT Consortium / relevant partner).

8.3 Legal Status of Certificates

Certificates issued through this platform are records of participation and completion within the SINFT Erasmus+ educational programme. They are not:

  Formally accredited academic qualifications under any national qualifications framework unless explicitly stated otherwise in the course description

  Legally binding professional licences or certifications in any regulated field

  Guaranteed to be recognised by any external employer, institution, or authority

 

The value and recognition of platform certificates outside the SINFT project context depends on the policies of the receiving institution or employer. We do not make representations regarding external recognition.

8.4 Certificate Integrity

Certificates are issued based on the completion data recorded by the platform at the time of issuance. Any subsequent finding that a participant engaged in academic misconduct (Section 7) in connection with the course may result in revocation of the certificate. We reserve the right to revoke a certificate where it was obtained through misrepresentation, system manipulation, or violation of these Terms.

8.5 Certificate Retention

Completion records and certificate data are retained for the duration of the SINFT project plus five years, in accordance with Erasmus+ project audit requirements. After this period, completion records may be anonymised or deleted. If you require a certified copy of your completion record, you should download and retain your certificate at the time of issuance.

 

9. Account Termination and Consequences

9.1 Voluntary Termination

You may request closure of your account at any time by contacting contact@porakanova.org. Account closure will be processed within 30 days. Please note the implications described in Section 9.3 before requesting account closure during an active course enrolment.

9.2 Termination by Us

We reserve the right to suspend or terminate your account, with or without prior notice, in the following circumstances:

  Material breach of these Terms and Conditions

  Confirmed academic misconduct under Section 7

  Behaviour that disrupts the platform or negatively affects other users

  Provision of false or misleading information at registration

  Request by the consortium partner organisation that enrolled you

  End of the SINFT Erasmus+ project and associated data retention period

 

Where termination is for cause (breach of Terms), we will endeavour to notify you by email before taking action, unless the nature of the breach requires immediate suspension to protect other users or the platform.

9.3 Consequences of Termination Mid-Course

If your account is terminated — whether voluntarily or by us — while you are actively enrolled in a course, the following applies:

  Your access to all course materials, activities, and platform features will cease immediately upon account closure or suspension

  Course progress data and activity records accumulated up to the point of termination will be retained in accordance with our data retention policy but will no longer be accessible to you

  If you have not yet met the completion requirements for a course at the time of termination, no certificate will be issued

  If a certificate was already issued prior to termination, the certificate remains valid unless revocation applies under Section 8.4

  Voluntary account closure is treated as withdrawal from all active course enrolments. Re-enrolment after voluntary closure requires a new registration and approval by the relevant organisational administrator

 

⚠ NOTE: If you are a learner enrolled through an institutional partner and your account is terminated at the partner organisation's request, any dispute regarding that termination should be directed to your organisation's administrator. We act on the instruction of approved organisational partners regarding the enrolment and access status of their affiliated learners.

9.4 Data Following Termination

Account closure does not result in immediate deletion of all personal data. Data retention obligations under the Erasmus+ grant agreement and applicable law require us to retain certain records (enrolment, participation, completion) for the periods specified in our Privacy Policy. You may submit a formal erasure request under GDPR Art. 17 — we will process it in accordance with our Privacy Policy, balancing your right to erasure against our legal retention obligations.

 

10. Intellectual Property

10.1 Platform Content

All content on this platform that is produced by or on behalf of the SINFT Consortium — including text, graphics, logos, icons, images, course materials produced by consortium staff, and software — is the property of the SINFT Consortium or its content suppliers and is protected by applicable copyright laws.

10.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, and revocable licence to access and use the platform content for personal, non-commercial educational purposes within the scope of the SINFT project. You may not reproduce, distribute, modify, or create derivative works from platform-owned content without our prior written consent.

10.3 User-Generated Content

Your rights in respect of content you submit are described in Section 6 above.

10.4 Third-Party Content

Course materials may include links to or embeds of third-party content (YouTube videos, Google Docs, external websites). Such content remains the intellectual property of its respective owners and is subject to their terms and licence conditions.

 

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the law of North Macedonia, the jurisdiction of the SINFT project lead partner (Poraka Nova Organisation), without prejudice to the application of GDPR (EU) 2016/679 and other applicable EU law.

Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of North Macedonia, without prejudice to your rights as a consumer or data subject under applicable EU law, including the right to bring proceedings before the competent data protection supervisory authority in your country of residence.
